Property Services

We are delighted to be able to offer Property Services that go hand-in-hand with some of our other Estate Planning tools.  These include severance of Joint Tenancies, and transferring the property to beneficiaries when an owner passes away.

Severance of Joint Tenancies.

There are two ways that a couple can own a home together: as Beneficial Joint Tenants (BJT), or as Tenants In Common (TIC).  Where a property is owned as BJT, each owner owns the whole of the property, and if one owner passes away, the equity in the property automatically passes to the surviving owner.  Where a property is owned as TIC, each owner owns their ‘share’ of the property, and the property will not automatically pass to the survivor if one of them passes away.  

Where a property is owned as TIC, each owner is free to leave their share of the property to a beneficiary in a Will.  Therefore, in order for a property trust in a Will to work correctly when an owner passes away, the property should be owned as Tenants In Common.

Where joint owners create a Property Trust Will, and they own their property as Beneficial Joint Tenants, we can change the way they own the property from BJT to TIC.  The cost of doing this is included in the prices of our Trust Wills.  Where joint owners wish to change how they own the property from BJT to TIC before they create their Wills, or separately to creating their Wills, we can offer this service for a stand-alone fee of around £120.  Please get in touch with us to confirm your requirements.

When a property owner dies.

When a sole or joint owner of a property has passed away, we are able to offer an extremely valuable service to our clients – to transfer the property into the surviving owner’s name, or into the name of their beneficiaries (if they have been nominated in a Will).  We are pleased to offer this service for a fee of under 0.1% of the value of the property.
